Terms and Conditions and Privacy Statement
1. The Spanish tax assistance services (“the services”) are provided by Spanish Tax Forms Ltd, a Company registered in England, number 6523058 (“we” or “us”). These terms and conditions represent a contract between us and the person completing our order form (“you”).
Services for non-resident property owners
2. This service comprises the calculation of tax due and completion on your behalf of Form "210" based on information you provide. The inclusive fee for this service is £34.95 (£39.95 for forms declaring rental income). You will be required to pay the tax at a Spanish bank.
3. If we have evidence that the information to be submitted is incorrect, we will not proceed. By completing and signing our order form you:
i) vouch that the information contained in it is correct and indemnify us from any responsibility if it is not;
ii) authorise us to obtain a Form 210 on your behalf and enter the necessary details on the form.
4. We agree to send the completed form to you within 5 days of receipt of your order form by us. You agree to indemnify us from any consequences in any case where the form is not submitted to the Spanish tax authorities by you within the deadline.
5. Completed forms will normally be sent by email. At your specific request, these forms can be password protected.
6. In addition to the preparation of tax forms, we can also arrange for the tax to be paid and the necessary formalities to be completed. In this case, we will first calculate the amount due to cover the tax and our preparation fee (£34.95 or £39.95 per property) plus £15 per owner, per year. We will pay the tax, notify the tax office via our partners in Spain and send you copies of the completed forms within 5 days of receipt of funds.
Services for shareholders
7. The service comprises the completion of a Form “210” on your behalf and its submission to the Spanish tax authorities in Madrid via our partners in Spain. The inclusive fee for this service is £34.95.
8. By completing and signing our order form you:
i) vouch that the information contained in it is correct and indemnify us from any responsibility if it is not;
ii) vouch that you were the beneficial owner of the shares in question or are the legal representative of the beneficial owner;
iii) vouch that you are a resident of the UK for tax purposes or some other jurisdiction covered by a double tax treaty with Spain and are eligible for relief from Spanish tax under this treaty;
iv) vouch that you did not acquire the shares in question as a result of business interests in Spain;
v) authorise us to obtain a Form 210 on your behalf and enter the details provided by you on the form.
9. Where shares were held in joint names each joint holder will be treated as entitled to an equal share of any gain made as a result of the sale.
10. We agree to file the 210 form with the Spanish tax authorities within the presentation "window" in January.
11. Completed forms will normally be sent by email. At your specific request, these forms can be password protected.
General
12. We do not accept any liability for any losses suffered by you or any other person for whom you are acting arising from any action, error or omission on our part or from any breach of our obligations to you under these conditions except where such losses are a result of fraud, wilful default or negligence by us or our employees or agents.
13. We are committed to the highest levels of service but if you do wish to make a complaint about any aspect of this service you should contact us first by telephone or email. Complaints will normally be resolved amicably but if you remain unsatisfied you may write to us at: Spanish Tax Forms, Horseshoe Farm, Mare Fen, Littleport CB6 1RH.
14. Any notice under these conditions must be given in writing to us at George Court, Bartholomew's Walk, Ely, Cambs CB7 4JW or to you at the address you enter on the form. These conditions shall be governed by English law and both parties submit to the jurisdiction of the English courts. Any contract between you and us pursuant to these Terms and conditions will be in the English language and communications from us will be in English.

The data controller for Spanish Tax Forms Ltd (“we”) is the Chief Executive.
What data we need:
When you request our services regarding non-resident or income tax in Spain, the personal data we collect from you includes:
· Your name, home and Spanish addresses and date of birth.
· Your NIE number in Spain.
· Your email address.
· The cadastral value of your property in Spain.
In addition, for services regarding declaring a gain from Spanish shares we also collect your NI number.
Why we need it:
· The legal basis for processing this data is that it is required to enable us to perform the services requested.
What we do with your data:
The data we collect will be used solely for the service you have requested.
We will not:
· sell or rent your data to third parties
· share your data with third parties for marketing purposes
How long we keep your data:
We will only retain your personal data for as long as the law requires us to. In general, this means that we will only hold your personal data for a minimum of 1 year and a maximum of 7 years.
Where your data is processed and stored:
We design, build and run our systems to make sure that your data is as safe as possible at any stage, both while it’s processed and when it’s stored.
Your personal data will not be transferred outside of the European Economic Area (EEA) except when requested by you.
How we protect your data and keep it secure
We are committed to doing all that we can to keep your data secure. We have set up systems and processes to prevent unauthorised access or disclosure of your data – for example, we protect your data using varying levels of encryption.
Your rights:
You have the right to request:
· information about how your personal data is processed
· a copy of that personal data
· that anything inaccurate in your personal data is corrected immediately
You can also:
· raise an objection about how your personal data is processed
· request that your personal data is erased if there is no longer a justification for it
· ask that the processing of your personal data is restricted in certain circumstances
